Terms and Conditions – Private Home Health Services (Georgia)
Effective Date: January 1, 2026
Provider: Prosperity Home Health Care, LLC (“Company,” “we,” “us”)
Client: The individual receiving services, or their legal representative (“Client,” “you”).

1. Scope of Services
Prosperity Home Health Care, LLC provides private home health and personal care services in the Client’s residence as described in the Service Agreement and Plan of Care.
We will not offer or provide services that we cannot reasonably expect to deliver in accordance with applicable Georgia rules and professional standards.

2. Service Agreement and Plan of Care
Services will be provided pursuant to a written Service Agreement and individualized Plan of Care, which will describe: services to be provided, level of care, schedule, fees, and any special instructions.
The Plan of Care may be updated as the Client’s condition or needs change, and the updated plan will govern services going forward.

3. Scheduling and Access to the Home
Client agrees to allow our staff safe and reasonable access to the home during scheduled visit times.
Client or responsible party will promptly notify us of any changes in address, contact information, or safety issues in the home environment.

4. Fees, Billing, and Payment
Rates for services (hourly, visit‑based, or flat fees) will be stated in the Service Agreement and may differ by service type and time of day or week.
Unless otherwise specified, payment is due as outlined on the invoice (for example, prior to services, weekly, or monthly), and Client remains responsible for all charges not paid by insurance or third‑party payers.

5. Refunds
Refunds, including prorated refunds and refunds in the event of early termination or Client death, will be handled in accordance with the Company’s written Refund Policy, which is incorporated into these Terms and Conditions by reference.
Any prepaid amounts will be applied, adjusted, or refunded consistent with that policy and applicable Georgia law.

6. Client Rights and Responsibilities
Client retains all rights under applicable federal and Georgia law, including the right to respectful, nondiscriminatory care, participation in care decisions, and the right to voice complaints without retaliation.
Client agrees to provide accurate health and contact information, follow the agreed Plan of Care to the extent possible, and notify the Company of any changes in condition or concerns about services.

7. Privacy and Confidentiality
We will protect the privacy of the Client’s health information in accordance with HIPAA and Georgia confidentiality requirements and our separate Privacy Policy, which is incorporated by reference into these Terms.
Client acknowledges receipt of the Company’s Notice of Privacy Practices and understands how health information may be used and disclosed for treatment, payment, and health care operations.

8. Staffing, Supervision, and Independent Contractors
All services are supervised by qualified staff of Prosperity Home Health Care, LLC, as required by Georgia regulations for private home care providers.
We may use employees and/or qualified independent contractors to deliver services; any such contracted services will be in writing, and contractors must comply with our policies and applicable Georgia rules.

9. Safety, Conduct, and Home Environment
Client agrees to maintain a reasonably safe environment for staff, including controlling pets, refraining from abusive, threatening, or illegal behavior, and addressing known hazards in the home.
The Company may suspend or terminate services if staff safety is at risk, illegal activity is present, or conditions prevent safe delivery of care, subject to applicable notice requirements.

10. Term, Suspension, and Termination of Services
These Terms apply for as long as services are being provided under a current Service Agreement.
Either party may terminate services in accordance with the termination provisions stated in the Service Agreement, subject to any required written notice, emergency situations, or nonpayment provisions allowed by Georgia law.

11. Complaints and Grievances
Client has the right to raise concerns or complaints about services, staff, or conditions without fear of retaliation or interruption of necessary care.
Complaints may be submitted to the Company’s office (in writing, by phone, or in person) and, if unresolved, to appropriate state or federal oversight agencies.

12. Limitation of Liability
To the extent permitted by Georgia law, the Company’s liability for claims arising from services will be limited to the amount paid for the specific services at issue, excluding claims involving gross negligence, willful misconduct, or conduct for which liability cannot be limited by law.
Client agrees to maintain any personal, medical, or homeowners insurance the Client deems appropriate to cover risks not assumed by the Company.

13. Governing Law and Venue
These Terms and Conditions, the Service Agreement, and all services provided by Prosperity Home Health Care, LLC are governed by the laws of the State of Georgia and applicable federal law.
Any legal action arising out of or relating to the services or this Agreement shall be brought in a court of competent jurisdiction located within the State of Georgia, unless otherwise required by law.

14. Entire Agreement and Amendments
These Terms and Conditions, together with the Service Agreement, Plan of Care, Refund Policy, and Privacy Policy, constitute the entire agreement between the parties regarding the services described.
The Company may revise these Terms as needed to comply with changes in law or regulations; material changes will be communicated to the Client, and continued use of services after notice will constitute acceptance of the revised Terms, unless otherwise required by law.
